The General Contracting Conditions govern the remote sales relationship between SON MORAGUES 1921 SLU and the user or customer, in accordance with legal provisions, in particular, Law 7/1998 of April 13 on General Contracting Conditions, Law 3/2014 of March 27 amending the consolidated text of the General Law for the Defense of Consumers and Users, Organic Law 3/2018 of December 5 on Personal Data Protection and Guarantee of Digital Rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996 of January 15 on Retail Trade Regulation, and Law 34/2002 of July 11 on Information Society Services and Electronic Commerce.

Such modifications may be made through its websites in any legally admissible manner and will be binding during the time they are published on the website until they are validly modified by subsequent ones. However, SON MORAGUES 1921 SLU reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Conditions when deemed appropriate, announcing them in a timely and proper manner. The changes referred to in this section will not affect contracts entered into prior to the date of their publication.
The purpose of the website is the sale of agricultural, artisanal, and food products, as well as the booking of various experiences.
The duration of the contract will be tied to the delivery of the product, without prejudice to the right of withdrawal.

Warranty
SON MORAGUES 1921 SLU is liable for any lack of conformity of all products offered on the website for a period of three years from the date of delivery.
The customer will be entitled to the repair of the purchased item within three years from the date of purchase, under the conditions and with the means of proof regulated in the Consolidated Text of the General Law for the Defense of Consumers and Users, without prejudice to the rights of SON MORAGUES 1921 SLU to verify the authenticity of the defects, their origin, and the time of their appearance.

All products display the sale price in euros and include Value Added Tax (VAT).
If any other tax is applicable, it will be indicated accordingly (IGIC or IPSI).

Product delivery is handled through DHL Parcel, DHL Express, SEUR, and Mail Boxes.

Payment Methods

VISA or MASTERCARD Credit Card

If the amount of a purchase has been fraudulently or improperly charged using a payment card number, the cardholder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and credit entries in the accounts of the supplier and the cardholder will be made as soon as possible.
However, if the purchase was indeed made by the cardholder and the demand for a refund is not the result of exercising the right of withdrawal or termination, and therefore the cancellation of the charge was improperly demanded, the cardholder will be liable to SON MORAGUES 1921 SLU for compensation for any damages caused as a result of such cancellation.
Bank Transfer
Upon selecting the bank transfer option, you will receive an email with the bank details of SON MORAGUES 1921 SLU along with the confirmation of your order.
It is very important that when making the transfer, you include the order number in the subject line, as well as your name and surname, and that you make the transfer within 3 days following the order confirmation date to validate it.

Otherwise, SON MORAGUES 1921 SLU may halt the shipment of your order if the full amount is not received.
Any potential exchange and bank fees are at the customer’s expense.
Order Execution
Delivery times: The delivery time will depend on the destination country. In general, the delivery time will be as follows:
Shipments are made on business days from Monday to Friday, excluding national and/or local holidays. Shipments are dispatched from Mallorca.
Orders for custom-made tableware are subject to an estimated production and delivery time of between 3 and 5 weeks.
International Shipping Notice: Shipments to countries with customs controls in place with Spain may experience delays beyond the estimated delivery times due to customs processing. These potential delays are beyond our control and cannot be guaranteed by us.
The transport companies we work with are DHL, SEUR, and Mailboxes.
The availability of the products offered by SON MORAGUES 1921 SLU may vary depending on customer demand. Although SON MORAGUES 1921 SLU updates its stock periodically, the product requested by the customer may be out of stock at that time.
In the event of non-execution due to unavailability, SON MORAGUES 1921 SLU will notify the customer as soon as it becomes aware of the situation via email or through the contact method provided. This communication will not exceed the stipulated delivery time for the order in any case. In such cases, if SON MORAGUES 1921 SLU does not have the product and cannot obtain it within the stipulated delivery time, it may offer the customer two possible solutions: 1) Supply the customer with a product of similar characteristics or superior quality at no additional cost; 2) Proceed with the refund of the amounts paid by the buyer for the canceled order.
Right of Withdrawal
The buyer will have a period of fourteen calendar days to withdraw, starting from the day the customer receives the product, without any penalty and without stating the reasons.
The customer must return the products subject to withdrawal without undue delay and, in any case, no later than 14 calendar days from the date on which the decision to withdraw is communicated.
The refund of the amount corresponding to the withdrawal will be made within 14 calendar days from the date on which the decision to withdraw from the contract has been effectively and unequivocally communicated, provided that the goods or products subject to withdrawal have been received beforehand. Otherwise, the payment may be withheld until the goods are received or until the customer provides proof of their return.
The user is informed that they will only be responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, or functioning.

SON MORAGUES 192 CENTER SLU will arrange for the collection of the product.
The customer will bear the cost of returning the product.
Payment Refund
The refund of the amounts paid by the customer will be made using the same payment method used by the customer, unless otherwise agreed.
SON MORAGUES 1921 SLU will refund the amounts paid by the customer within 14 calendar days from the date of receipt of the right of withdrawal.
Return of Defective Product
If, upon receiving your order, the product is not in good condition and the reason is not attributable to the customer, you will have the right to return it at no additional cost. To do so, you must inform SON MORAGUES 1921 SLU of the reason for the return using any of the communication methods indicated in these terms and conditions.
In such cases, the product will be replaced with the same item, provided it is available. If this is not possible, the corresponding refund will be issued. This return due to a defect or poor condition of the product shall not be considered a right of withdrawal.
If it is possible to replace the product with an identical one, SON MORAGUES 1921 SLU will cover the cost of the return.
However, the customer is informed that many of our products are handcrafted, and as such, they may present slight variations in finish, shape, or color due to the artisanal production process. These particularities are not considered defects but rather features that make each piece unique.
SON MORAGUES 1921 SLU undertakes to cover the cost of the return and to replace the product with a new one in accordance with the conditions accepted at the time of sale.

Should any dispute arise, the parties may submit their conflicts to arbitration or resort to ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard. In the event of cancellation by the company due to unforeseen circumstances, an alternative date will be sought, or the money will be refunded.
